SEPARATION OF POWERS: A BEAUTIFUL THING

The California Coastal Commission has just been ruled unconstitutional by the Third District Court of Appeal in Cowtown. The opinion reads like a poem:

It is appropriate here to emphasize that our legal conclusion--that the process for appointing voting members of the Commission violates the separation of powers doctrine--is limited to the specific facts of this case, where a majority of the Commission’s voting members are appointed by the legislative branch and may be removed at the pleasure of the legislative branch and there are no safeguards protecting against the Legislature’s ability to use this authority to interfere with the Commission members’ executive power to execute the laws. We express no opinion regarding the propriety of legislative appointments to administrative agencies
under circumstances different than presented here.


It is not everyday that a powerful body of governance is ruled unconstitutional--especially when such a valuable resource as the coastline is at stake. The state congress' power to influence or otherwise emasculate the CCC officials' capacity to make key executive decisions muddled the law enforcement objective, which is the primary goal of the CCC to begin with.

The CCC has been out of hand for a while, denying property owners fair use of their property by requiring public easements through privately owned land among other development snafus. I think nothing is as effective at combating this type of Marxism-Leninism emanating from California government than the separation of powers clauses that are cemented into place in the American legal system. The mixing of legislative and executive branches should not be tolerated by a free society.

The language is simple enough (Art. 3, Sec. 3):

SEC. 3. The powers of state government are legislative, executive, and judicial. Persons charged with the exercise of one power may not exercise either of the others except as permitted by this Constitution.

You would be surprised at how many ways these two sentences can be interpreted, comrades. Let us give thanks to the almighty for the 3rd District's disembowelment and execution of the California Coastal Commission as violative of the separation of powers clause. Amen.

A DOUBLE INDICTMENT

The story of what occurred on Nov. 4, the day before the mayoral election, is not only an indictment of a lifelong liberal politician with an until-now-unblemished record in Sacramento, but also an indictment of the local press, which was informed of the story but ignored it until it could no longer be ignored. Had the news been printed on election day, it's not clear whether the outcome would have changed.

Thanks from the bottom of our hearts, Daily Cal. I especially like Tom Bates' attitude towards theft, in spite of eyewitness accounts:

Coyne grabbed her Kodak Fun Saver camera, missing the actual dumping of the broadsheets, but photographing Bates afterward. She later handed the camera over to campus police.

Minutes later, Daily Cal city editor Mike Meyers approached Bates. When asked, Bates denied he had dumped the newspapers. Their conversation, according to the police report, ended with Bates telling the journalist, "C'est la vie."


How fucking arrogant can you be, Tom Bates? Trashing the California Patriot is an unbelievable act of desperation usually reserved for campus terrorists, of whom Bates is now a member of:

On the morning before the vote, Bates was distributing campaign literature at Sproul Plaza, birthplace of Berkeley's political dissent. Wearing a blue and gold sweater, which the police report said made him easy to spot, Bates approached the Berkeley College Republicans' table, whose members were handing out their magazine, the California Patriot. He repeatedly asked for copies of the magazine.

That chagrined economics major Kelly Coyne, a campus Republican activist who was handing out the magazine. She found Bates charming when he spoke at her sorority, but the Patriot had written more favorably about Dean and found both candidates too liberal to endorse.

Coyne could not understand why Bates kept returning to the Republican table to pick up copies of the magazine. She described his behavior as downright "weird."


Tom Bates is a fucking weirdo. Thanks for printing it, LA Times.

Despite his many apologies, Bates has not apologized to the Republican students or to Dean, his opponent.

UC MOVES INTO COWTOWN

The UC "quietly" purchased a four-story building in downtown Sacramento. This was done in closed session, and the intention to better influence public policy should be considered the modus operandi (the article is here):

Plans for the project have been developing quietly. The UC regents approved the building purchase in November 2001 in a closed session. The action was made public in a report that is sent to regents between meetings and made available to the members of the public if they request the document, McFadden said.

Soon the UC will have its lobbying army of interns (provided by the equally evil-leftist and balkanized California Alumni Association) right at the steps of the Capitol. There never really seems to be a budget "crisis" in the UC. There is money in the system, but it is largely hidden from public view:

"I don't think we have $2 billion tucked away someplace, but it doesn't have the virtue of truth to say that all of our money is allocated," said Connerly, adding that regents have no clear idea of how much excess funds the university maintains.

I think the public ought to know how much money and real property the system has and start making the system accountable to the public it serves. We need the "virtue of truth," given the exponentially increasing population size due to failed immigration policy in the Golden State, and we are going to need some of that money to build more prisons. Public safety always comes before public handouts, something even the knuckleheads in Sacramento seem to understand. Alas, Sacramento doesn't dictate to Oakland, as it operates as an independent or "quasi-public corporation." Since the taxpayers can't control anything the Regents do, Sacramento should cut off UC funding until it expends it financial reserves and makes them accountable to the public.

As for the UC, anything that is not being put to use should be liquidated before the taxpayers fund another red cent to this institution of communalism. A political heterodoxy of 99% New or Progressive Left faculty should not be borne from my wallet, nor shall my wallet fund the academy that seeks to turn California into a Marxist-Leninist state. The UC system needs a series of purges of property and persons from its seedy bowels--as it has become more of an institution of thought reform, and not of higher learning.

A SCARY THOUGHT

Cruz Bustamante is running the state right now while Davis is visiting his ailing mother back east. The Lt. Gov. has long been a hateful, divisive person and Mexican Nationalist. Let us pray he does not call for secession to Mexico on Christmas, comrades.

Speaking of hateful Mexican Nationalists, check out this guy, freshman Congressman Raul Grijalva (D-Mexico), calling militia groups protecting the border in Arizona "racist" with ties to "white supremacy." When you have nothing to undermine the sovereignty of the United States, the race card is the last one you draw.

Like Bustamante, Grijalva is a Mechista. Apparently, the belief of Brown supremacy is deeply entrenched in Arizona, and, like California, the eradication of the white man may soon follow. They call it "changing demographics," the current euphamism for the invasion and reconquest of the Southwest by Mexican nationals. Since the INS can't do a very good job, citizens have taken it upon themselves to protect the homeland by apprehending illegal trespassers. I applaud these good citizens.

A NOT-SO-SCARY THOUGHT

In fact, we need more citizens like Ranch Rescue and like this guy, Gary Gorski, defender of the Second Amendment. A "scrappy lawyer" who understands one thing: you only have the rights you can defend with your gun. Let's hope the Supreme Court hears his case and he prevails, comrades.

ANOTHER WORTHLESS MUNICIPALITY

Like Berkeley, Oakland is shithole, but on a much larger scale. This is a city that has its fair share of lunatics (welcome back, James) and millions of dollars that can't be accounted for. Instead of using your taxes to clean up the streets, the City of Oakland uses your taxes to advertises on bus stops, buses and billboards telling people not to litter. My friend's house at 7th and Peralta has had an engine block sitting on the parkway across the street for at least a year. Let us not forget how many people have died in the city and in that neighborhood this year. At three in the morning, crack fiends roam the streets like zombies looking for anything to steal. It's really creepy.

Like Berkeley, the council is hopelessly leftist, and also passes worthless resolutions. Guess what, Oakland? The Patriot Act isn't going away anytime soon. Now stop crying. You can't cry every time you don't get your way. Now get back to work undermining American culture and ceding American territory to the third world. It's what you're good at.



EVERYTHING IS ON THE TABLE

Get ready to tighten your belts, lefties. The Chron is reporting that a projected 200 million budget deficit for SF is going to hit hard, and no one is going to be happy about it, (except for me, of course). The free government cheese is about to run out, comrades:

"I fear that the worst is yet to come," Rosenfield said.

But already it's evident that the governor is proposing to take away money for libraries, road repairs, child care, affordable housing and health care for the poor.

"I have no words to express how devastating this is going to be to the city, " said Supervisor Aaron Peskin, chairman of the Board of Supervisors Finance Committee.


I have words to express the "devastation:" Hooray for less Marxism-Leninism!

Rosenfield delivered the bad news Wednesday and is scrambling to figure out how the city budget will be balanced, which is required by law. Recommendations for the first round of cuts, to deal with the fiscal year that ends June 30, will be made next month.

"It's fair to say everything's on the table," Rosenfield said.

TOM BATES NEEDS A TIMEOUT AND AN ORANGE JUMPSUIT

Many Republicans are calling for Tom Bates to receive a "timeout," which is likely a result of protesting pre-schoolers and the comments made by city councilwoman Linda "Maio Zedong" Maio. While I call for Bates to go to jail, at least one San Fransisco columnist is willing to meet me halfway:

Bates has apologized profusely for his profound lack of judgment and says he will do much more than pay a maximum fine of $250. Those are all nice, respectable reparations that Bates can make in the course of his usual work day.

But I need to see a real sacrifice for crime against your own people, Mr. Mayor.

I need to see Mayor Bates somewhere on University Avenue some Saturday participating in a community cleanup project, but here's the catch.

He's gotta wear one of those orange vests, the ones that tell passers-by that he's no volunteer. He's there because he screwed up.

That act of humility is a good way for Bates to prove he's not the kind of self-centered, cynical, arrogant career politician who would trash a student newspaper to win an election.


Great idea, except Tom Bates is a self-centered, cynical, arrogant career politician, who also happens to be a thief and a liar to boot. This is all just wishful thinking, comrades. I would rather see him locked up in a stock in the middle of Sproul with a dunce cap on his head so we all can take pictures with him and throw rotten tomatoes at his face. Whatever the case, Berkeley voters, say hello to four more years of a crumbling sewer system, high crime rates, violent beggars on Telegraph Avenue, muriatic acid graffiti and worthless council resolutions resounding in symbolism.

Of course, the only good part about the next four years is when the budget cuts start coming, lots of free government cheese (wasteful and ineffective "social services" programs) will be cut. It will be good to hear the lefties whine when their purse strings are drawn tighter. Yay for fiscal responsibility! Hisssss to Tom Bates!

I told you not to vote for this idiot, and what did you do? You elected him mayor. Bastards.

I told you these leftist politicos have no moral or ethical standards of decency, but you did not heed my warning. Tom Bates is a thief who should be incarcerated. Instead, ignoring all possible conflicts of interest in the fact that Bate's son is an Alameda County District Attorney, the DA gave Bates a little slap on his behind. Bad boy! What is the price of free speech? Two hundred and fifty bucks. What is free speech worth to Bates? Five hundred bucks. Free speech can be yours for the mere price of seven hundred and fifty dollars in the City of Berkeley, County of Alameda, State of California, United States of America, comrades. Don't worry, the city council won't condemn you for your crimes against the public.

If this is what Bates does in Sproul Plaza, imagine what kind of thuggery he practiced in Sacramento for two decades. Thank gawd for term limits, comrades. I am sort of glad he can live in his own personal hell here in Berkeley rather than inflicting his purely malicious will in Sacramento.

He stole. He lied. He conspired. He covered it up. He violated the public trust. He should never be allowed to hold a public office. But he will hold public office because he is above the law. He should resign, but he won't. He should be recalled, but he won't. Had his constituency known he was a thief, he would not have been elected. Now, as penance, he is saying he is going to legislate and talk to kiddies (presumably about how to steal newspapers and get away with it).

He is a tyrant, a despotic piece of filth. He is a typical hypocritical leftist-progressive-Marxist-Leninist-Stalinist consumed by his own intolerance. He is indifferent to his constituency, blind with power. His wife is evil, the devil herself. This is the hell of Berkeley politics: free speech for me, but not for you.

WHO'S YOUR DADDY, MEChA?

They found the oldest skull on the American continent, and guess what? She, like Kennewick man, was white:

Scientists from Liverpool's John Moores University and Oxford's Research Laboratory of Archaeology have dated the skull to about 13,000 years old, making it 2,000 years older than the previous record for the continent's oldest human remains.

However, the most intriguing aspect of the skull is that it is long and narrow and typically Caucasian in appearance, like the heads of white, western Europeans today...


Silvia Gonzalez, a Mexican-born archaeologist working at John Moores University and the leader of the research team, accepted yesterday that her discovery lends weight to the highly contentious idea that the first Americans may have actually been Europeans.

So you now have proto-Caucasoids stretching from Washington State to Mexico City. Looks like the Chicanos are the brutal invaders of this continent, or better yet, Europeans are the forefathers of Chicanos (or similarly oppressed "indigenous" peoples). Do you know who your daddy is, Mr./Ms. Mechista?

I think campus groups like MEChA should re-evaluate their positions in light of the scientific fact that white people were here first. Caucasoids are the true indigenous peoples of this continent.

[Contrary to rumor, I don't believe that race is a social construction. It exists, but I fail to see its importance in a heterogeneous society. However, I believe that there is nothing more socially divisive and harmful as racial awareness, classification and separation.]

All of this scientific proof has to be more than a little unsettling to Chicano activists. You can't argue with carbon dating. So what do you say, MEChA? Time to renounce the documents and repatriate Siberia? You are on our land, Chicanos! Aztlan is on the other side of the Bering Strait. You are in the wrong neighborhood. Go north and make a left when you hit Alaska.

RACIAL QUOTAS CREATE CORRUPTION

SFO Airport has been a tremendous sinkhole of public funds. Only now is the shit starting to rise to the top:

Now, more than five years later, the city attorney is accusing the partnership of being bogus all along --set up to defraud the city's minority contracting program of $8 million by falsely claiming it was controlled by a minority-owned company, San Luis Gonzaga Construction Inc.

City Attorney Dennis Herrera filed a lawsuit in October against San Luis Gonzaga's partner, Brisbane Mechanical Co., claiming that owner William D. Spencer of Hillsborough knowingly used San Luis Gonzaga as a minority front to win city contracts.

A minority front? Impersonating a minority as crime? This waste of taxpayer funds and subsequent corruption is what characterizes racial quotas in the distribution of lucrative government contracts. If it doesn't go to the lowest bidder, you the taxpayer pays for this type of racial discrimination and waste of money. I especially love how the SF City Attorney is using a policy racial quotas that is now illegal to throw the book at these alleged criminals. This is the same City Attorney who has flouted the California Constitution with its continued MBE program of racial quotas ever since the constitutional ban on affirmative action. How is the irony of that?

THIS IS A GREAT NEW STEP

Vicente Fox's Institute for Mexicans Abroad (created when Juan Hernandez was fired) now has an advisory council and is now headed by Candido Morales, a dual-national. Mr. Morales' plan for re-conquest can be found here.

As part of the Institute for Mexicans Abroad, there will be an Advisory Council consisting of 120 members, most of them Mexicans and Mexican-Americans who reside in the United States.

Candido also says "Mexico will be better able to achieve its full potential by calling on all members of the Mexican Nation..." That Mexican Nation is the Southwestern United States, comrades.

Another dual national in Fox's cabinet is Ernesto Ruffo Appel. As American citizens, Mr. Morales and Mr. Ruffo Appel have no business working for the Mexican government. Both of thier US citizenships should be revoked, and they should be deported to the country to which they serve and to which their loyalty lies: Mexico.

The Institute for Mexicans Abroad actively recruits other US citizens (and dual-nationals) to serve in the Mexican Government, as UC Berkeley's very own Ms. Xochitl (not her real name) Castaneda (who is also director of this treasonous waste of taxpayer dollars) pointed out:

This is a great new step. It's the first group for Mexicans that has a direct connection to the Mexican government to solve practical problems," she said.

This is a governmental program founded upon race (raza) as a basis for foreign governmental representation. It is treason, and it must be stopped. Any United States citizen who works for the Mexican Government should have their citzenship revoked, and be deported to Mexico. You should be loyal to your country, or face the consequences of being kicked out.

But the revolutionaries have a different view of Morales' advisory council:

"This council was formed merely to be political cannon fodder for Fox," said Miguel Araujo, a San Bruno restaurant owner who also is coordinator of Centro Azteca, a nationwide activist group, and is secretary-general of the California chapter of Mexico's left-of-center Democratic Revolution Party.

That's right, Mexican political parties (who run candidates only in Mexico) exist right here in California. Will Mexican political parties run their candidates in California? Only time will tell, comrades. Transnational movements take some time to foster, as any good Marxist-racist will tell you.



LAMENTATIONS OF A RACIST MECHISTA

The Aztlanian conquest has spread to Oregon which, coincidentally, was never a part of Mexico:

MEChA member Gerardo Ochoa said he doesn't think the University has been doing an adequate job of recruitment and retention of students of color.

When has a Mechista (or similar separatist organization) ever been satisfied? Never.

"I think there is more to be done before the University can claim to be a diverse place," he said. "The University takes some pictures of students of color for brochures and posters and paints the picture of color, 'Oh, welcome to this diverse place,' when it's not."

Read: As a Mechista, I feel uncomfortable around people who don't look like me, but in order to properly racially segregate the campus, we need more people who look like me. As a Mechista, I don't have to express tolerance towards the melanin-challenged peoples, it is my duty to eradicate them from the system and liberate the University from the oppressive and brutal gringo invaders of Oregon.

Ochoa said he thinks part of the problem is the lack of multicultural recruiters; the admissions office has only one.

Many students of color do not want to stay at the University because it is predominately populated by white students, Ochoa added. And if the University had a greater number of ethnic instructors, many students might be more inclined to attend the University, he noted.

This is premised upon the "role model" theory which states that white people cannot identify with "persons of color" because they have internalized their racism. This statement is also premised upon the inferiority complex theory, which states that as a group of Mexicans, Mechistas are too stupid to tackle the University on their own merit, and that they need special help to overcome what every other student has to go through to graduate.

"We can't just have faculty of color in the Ethnic Studies Program," Ochoa said. "All the departments need to be diversified."

Read: We need to fire and displace all of the white people at the University and send them off to refugee camps in Idaho while the re-conquest goes full bore ahead.

I am glad they print this stuff, because no one would believe what is being produced on our college campuses in the 21st century.
